1 Scope of Services
Comfort Digital provides professional digital marketing, consulting, advertising management, website development, hosting, maintenance, CRM, and software-related services on a best-effort and advisory basis unless otherwise agreed in writing.
2 Retainers & Ongoing Services
Monthly retainers are billed in advance and are non-refundable once the service period has commenced. Retainers cover access to expertise, time allocation, and execution capacity, not guaranteed outcomes.
3 Advertising & Performance Disclaimer
The Company does not guarantee specific results including but not limited to revenue growth, lead volume, conversion rates, ad performance, rankings, or return on investment. Advertising outcomes depend on third-party platforms, market conditions, budgets, client inputs, and external factors beyond the Company’s control.
4 Client Responsibilities
Clients are responsible for providing accurate information, approvals, assets, access credentials, and lawful authority to use all materials supplied. Delays caused by the client may affect delivery timelines and performance.
5 Payments & Refunds
Payments are due as per invoice terms. Services are non-refundable unless explicitly stated in writing. Late payments may result in suspension of services.
6 Intellectual Property
All intellectual property, deliverables, and work products remain the property of Comfort Digital until full payment has been received. Upon settlement, ownership transfers unless otherwise agreed.
7 Limitation of Liability
To the maximum extent permitted by law, the Company’s liability is limited to the fees paid for the relevant service period. The Company is not liable for indirect, consequential, or loss-of-profit damages.
8 Termination
Either party may terminate services subject to agreed notice periods. Outstanding fees remain payable.
9 Governing Law
These Terms are governed by the laws of the Republic of South Africa.
